
| AMOS RUN HUNTING CLUB, INC. EFFECTIVE: 15 AUGUST 2006 BOARD OF DIRECTORS GENERAL RULES AND REGULATIONS It is the desire of Amos Run Hunting Club, Inc, to provide its members, as well as authorized guests, the ability to enjoy the hunting sports, and various other recreational activities. It is A.R.H.C.’s position that sportsmanship, life safety, and respect for property and fellow club members should never be compromised for personal pleasure, or any other reason. As such A.R.H.C. has adopted the following Rules and Regulations to be adhered to when within the confines of the club. A.R.H.C. is a private club and reserves the right to refuse any application for issue and/or renewal of permits. POINT SYSTEM: Points will be assigned to the member for violations of club rules. When a member accumulates 10 points, his/her permit will be revoked for the remainder of the original period of issue. Depending upon the nature of the violations, and past history of disregard of club rules on the permit holder’s part, application to obtain a new permit for subsequent issue periods may be denied by the Board of Directors. Points will be removed from the member upon renewal of his/her permit for hunting and or other recreational activities of W.R.H.C. Points will be assessed only by the Board of Directors, and upon reasonable belief that a permit holder has engaged in activities in violation of club rules. Reasonable belief may be established upon the Board of Directors receipt of a written complaint from a permit holder who has observed a rule violation. The complaint must contain the alleged violator’s name, the time and date the alleged violation occurred, that area of A.R.H.C.’s property the violation occurred on, a brief description of the violation, any other witnesses present, the signature of the person making the complaint, and a means to contact the member making the complaint. The Board of Directors, upon determination that a reasonable belief exists that a member is in violation of the club rules, will notify the member of such and furnish him/her with written notice of the violation and the amount of points assessed to their permit. Should the permit feel as though the Board of Directors has acted in error, the member has 15 calendar days from receipt of said notice to submit a written statement containing an explanation as to why they feel the Board is in error. The Board of Directors will review the member’s statement and will uphold the original assessment, remove the assessed points, or ask the permit holder to appear at the next scheduled Board as requested, will be considered by the Board to be in agreement with the original notice of rule violation, and the amount of points assessed for the violation. A.R.H.C. reserves the right to revoke any issued permit for cause or no cause with written notice to permit holder. Members revoked for no cause will be pro-rated and the member will be refunded issuance fee accordingly. RULE VIOLATIONS PERTAINING TO HUNTING : The General Hunting Regulation as published by the West Virginia DNR will be adhered to by all members. DNR will be patrolling within the boundaries of A.R.H.C., and have been asked to notify the Board of Directors of those, on club grounds that have been cited for a violation. Upon notification by a representative of the DNR that a member has been cited for a violation of the General Hunting Regulations, the member will be assessed points in the following manner: 10 Points: Use of artificial light with firearms or other implement. 6 Points: Illegal possession or illegally killing deer, bear, boar or turkey. 6 Points: Hunting from a motor vehicle. 4 Points: All other hunting violations. Notification and appeal procedures are the same as listed in POINTS SYSTEM section. GENERAL RULES AND REGULATIONS : All persons holding any classification of membership authorizing participation in recreation activities on club property are expected to following all rules and regulations of the club. Violation of any of the following rules will result in point assessments as indicated. 10 Points: Arguing and/or fighting among members. 10 Points: Use of other than your own gate key, or allowing others to utilize your gate key. 10 Points: Stealing of, or destruction of club property, or any item, building, equipment, etc. on club property. 10 Points: Conviction of a criminal offense committed on club property that carries with it confinement of more than one year in the county jail, or state penitentiary. 10 Points: Any action or deed that is indicative of disregard for life safety. 10 Points: Filing of a false complaint with the Board of Directors. 10 Points: Engaging in activities not covered by membership. 10 Points: Failing to supervise minor children while operating ATV. 10 Points: Allowing a minor child to operate an ATV without a DOT approved helmet. 10 Points: Camping in other than a designated area. 10 Points: Unauthorized guest on club property. 10 Points: Having a ATV on a new timbered area “MARKED OFF LIMITS”. 6 Points: Hunting within 300 feet of a camp or occupied campsite. 6 Points: Hunting over food plots planted and maintained by the club. 6 Points: Hunting over food plot or feeder of another member without written permission. 6 Points: Hunting from another member’s tree stand without permission. 6 Points: Nailing any item to a tree. 6 Points: Cutting of standing timber. 6 Points: Campfire in other than a designated area. 6 Points: Any violation of state burning laws. 6 Points: Any action or deed that disrupts or interferes with fellow members’ recreational activities. 6 Points: Use of a center fire or rim fire rifle to take wild turkey. 6 Points: Use of a firearm between the last day of spring turkey season and the first day of small game season on club property in other than a designated area. 4 Points: Use of ATV or any other motorized vehicle on any area other than existing roads. 4 Points: Littering. 4 Points: Failing to mark portable tree stands with metal tag bearing name, phone number, and key number on it. 4 Points: Failing to furnish a copy of checking tag to the club office for club records. 4 Points: Failure to display club sticker on camper when using a designated camp site. 4 Points: Removing wheels from camper. 4 Points: Use of an ATV for any other purpose than traveling to and from hunting areas, and to assist in the retrieval of game from the first day of archery season through 31 December, with the exception of Sundays. 4 Points: Speed limit of no more than 30 mph on club property. DEFINITIONS: The following definitions are provided to assist in the application of club rules: ATV All Terrain Vehicle. AUTHORIZED GUEST Any individual whose presence on club property is sponsored by a member, and has been pre-approved by the Board of Directors. DNR Department of Natural Resources. DOT Department of Transportation. MINOR CHILD Any person under 18 years of age. Any member wishing to seek pre-approval for a minor child to be on club property and to participate in activities on club property must have written consent from the child’s custodial parent or legal guardian. A copy of the consent must be filed at the club house, and must be filed at the club house, and must contain acknowledgment that the miner child has parental or custodial approval to be on club property, and that the member bears sole responsibility for the minor child while on club property. MEMBER The name the card has been issued in. MEMBERSHIP A written authorization to be upon club property and to engage in activities as indicated. A membership covers the holder, his/her spouse, and their minor children. ORIGINAL PERIOD OF ISSUE That specific period of time a membership is issued for, normally a period of one year. SUBSEQUENT ISSUE PERIODS That period of time a membership would stand good for upon its next scheduled renewal. UNAUTHORIZED GUEST Any person on club property sponsored by a member whose presence has not been pre-approved by the Board of Directors. A.R.H.C. Amos Run Hunting Club, Inc. MISCELLANEOUS: A.R.H.C. is not responsible for supplying members with the West Virginia General Hunting and Fishing Regulations. Copies may be available at the club house for review. It is the responsibility of the members to become familiar with these regulation, and to abide by them. Dog hunting or training is not authorized on club property during the spring turkey season, the first two weeks of archery season, and the two weeks of gun season for antlered deer. A reward of $5,000.00 will be given for information leading to the arrest and conviction of anyone committing arson on club property. Memberships must be renewed by the due date each year. We will attempt to send out reminders via e-mail or phone 30 days prior to the expiration date. Memberships not renewed on time will go to the end of the waiting list. Persons in possession of a concealed carry permit are authorized to carry concealed in accordance with State Law. A.R.H.C. reserves the right to change, alter, modify, add, delete and revise its club rules at any time and without advance notice to members. The Board of Directors will not accept anonymous complaints. In instances where a person submits a complaint, and request to have their identify protected, the Board of Directors will make every effort to do so if they determine it is in the club’s best interest.
